Terms & Conditions

• “Service” means the AI voice agent platform, dashboards, APIs, and any associated tools provided by Pineyard AI.
• “Subscription” means a paid plan that grants access to the Service for a recurring billing period.
• “Credits” means prepaid or plan-included usage units consumed when the Service places or receives calls.
• “End User” means any third party your AI voice agent interacts with on your behalf.

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep it updated.

The Service is offered on a subscription basis with usage measured in Credits and/or minutes, as described on our pricing page. We may offer monthly and annual plans. Plan inclusions, limits, and pricing are displayed at the point of purchase and form part of these Terms.

• Subscriptions are billed in advance for each billing period (monthly or annual) through our payment processor.
• Unless cancelled, subscriptions automatically renew at the end of each billing period at the then-current rate. You authorise us to charge your selected payment method on each renewal.
• If your usage exceeds the Credits or minutes included in your plan, overage charges apply at the rates published on our pricing page. Overage usage is billed in the next invoice cycle.
• All fees are exclusive of applicable taxes (including GST), which will be added where required by law.

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You specifically agree that, when using the Service for outbound or inbound calling, you will:

• Comply with the Telecom Regulatory Authority of India (TRAI) regulations, the Telecom Commercial Communications Customer Preference Regulations, and all applicable DLT (Distributed Ledger Technology) registration requirements for commercial communications.
• Obtain all consents required from End Users before initiating automated or AI-driven calls.
• Not use the Service for fraud, harassment, spam, unlawful telemarketing, or any communication that is deceptive, abusive, or misleading.
• Not attempt to reverse-engineer, resell, or misuse the Service or its underlying technology.

You are solely responsible for the content of the scripts, prompts, and messages your AI voice agent delivers, and for ensuring they comply with law. We may suspend or terminate access for violations of this section.

All rights, title, and interest in and to the Service, including the platform, software, models, and documentation, are and remain the exclusive property of Pineyard AI and its licensors. These Terms do not grant you any ownership of the Service. You retain ownership of the content and data you upload, and you grant us a limited licence to process it solely to provide the Service.

We process your data in accordance with our Privacy Policy. Each party agrees to keep the other’s confidential information secure and to use it only as necessary to perform under these Terms.

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be subject to downtime for maintenance, updates, or factors beyond our control, including third-party telephony and AI infrastructure. We may modify, enhance, or discontinue features of the Service at any time.

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. Pineyard AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of the Service.

In all cases, the total aggregate liability of Pineyard AI arising out of or relating to the Service shall not exceed the total amount of fees paid by you to Pineyard AI in the three (3) months immediately preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Pineyard AI and Harshit Pandey from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content or scripts, your violation of these Terms, or your violation of any law or the rights of any third party (including any End User).

These Terms remain in effect for as long as you use the Service. You may stop using and cancel the Service at any time as described in our Refund & Cancellation Policy. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service unlawfully.

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Durg, Chhattisgarh, India. The parties shall first attempt to resolve any dispute amicably; failing which, the dispute may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Durg, Chhattisgarh, India.

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
